Lab results reveal no intoxicating substances

A city council member charged last August with DUI after a traffic stop by Durant Police had the charge dismissed after lab results revealed there were no intoxicating substances in his system.

Danny Lynn Sherrer, 73, was arrested while driving on the Highway 70 bypass for suspicion of driving under the influence of an intoxicating substance.

He also was charged with carrying a firearm while under the influence. Police said that during a field sobriety test, there were signs of impairment, however, he passed a breathalyzer test that revealed there was no alcohol on his breath and a blood sample was drawn.

Court records state that when lab results were available last month and revealed there were no intoxicating substances in Sherrer’s system, District Attorney Tim Webster requested the case be dismissed. District Judge Mark Campbell then ordered the charges be dismissed.

Sherrer represents Ward No. 3 and he was first elected to city council in April 2019. During his time on the council, he has served as vice mayor and acting mayor.
