EDWARDSVILLE — A Gillespie man was charged Monday in Madison County Circuit Court with two felony charges of unlawful possession of a controlled substance (heroin and hydrocodone), and one felony charge of offenses related to motor vehicles, Madison County Sheriff Robert J. Hertz said in a press release.
The man is identified as Layne J. Withers, 19, of the 700 block of East Spruce Street.
On Jan. 11 at approximately 3:31 a.m., the Madison County Sheriff’s Office responded to Livingston Drive, near Lindenbroker Road, Staunton, in reference to a single-vehicle traffic accident. An inquiry on the vehicle’s registration revealed it was entered as a stolen vehicle by the Gillespie Police Department.
Deputies arrived and made contact with the driver, identified as Layne J. Withers. Withers told deputies he took the vehicle without permission from a family friend. Withers said he crashed the vehicle when he leaned over to grab a cigarette. Withers was arrested for being in possession of the stolen vehicle. A subsequent search of Withers and the vehicle revealed he was in possession of approximately .5 grams of heroin, two hydrocodone tablets and a package of syringes.
Withers was transported to a hospital for medical evaluation. After being medically cleared for detention, Withers was transported to the Madison County Jail, where he was held pending a formal review of facts by the Madison County State’s Attorney’s Office.
The felony warrant and information was signed by the Honorable Judge Richard Tognarelli, who set bond at $75,000. Withers was also issued citations for failure to reduce speed to avoid an accident and improper lane usage.
