Calera Council considers annex to put adult store in city limits

Calera Council is considering annexing property south of the present town limits to take in an adult novelty store that is expected to open soon.

The council met Thursday evening and agreed to ask David Kelly, the town’s attorney, to be present for the next meeting for discussion on the proposed annexation.

Calera town limits presently go to the center of Platter Road and the business is located on the southwest corner, just outside the present limits. Also, officials said that Luke Bros. Propane would like to be in the town limits.

Officials said the new building will house an “adult novelty” store, and want police to be able to control the activity in the area.

“I’d like to get it annexed so we can get the sales tax off of it, plus control the surrounding area,” said Mayor James Eaton.

In other action, the council is expected to change the fireworks ordinance when a new ordinance is prepared for next month’s meeting. Under a current ordinance passed a few years ago, fireworks can be detonated between June 15 and July 6 from 9 a.m. until midnight. Council members said there have been complaints about this and they plan to change it back to a 1987 ordinance that allowed fireworks to be used from 8 a.m. until 11 p.m. July 1-5.

The council is also expected to require a $50 permit for the sale of fireworks in the town limits.

Council members approved an ordinance on smoking in public places and indoor workplaces as mandated by state law. Under the law, smoking is banned within 25 feet of public buildings and inside most businesses. Passing the ordinance gives police the authority to ticket violators.

Vice Mayor David Westbrook dissented because he said he does not agree with the state law.

“I think it’s communism,” Westbrook said. “Not so much the (smoking in) public places, but if a man has his own business and he wants to smoke in it, he can’t.”

Council members also approved the Prevention of Youth Access to Tobacco Act, and Westbrook seconded the motion to approve this.

The council also conducted the following business:

— Approved hiring an employee for the street department to patch potholes, trim limbs, mow around the park and other work

— Approved a request for all of the proceeds of the “Guns and Hoses” softball tournament between the police and fire departments Sept. 19 to be awarded to the Crisis Control Center

— Took no action on putting a gate at the cemetery

— Tabled action on building a kennel to house impounded animals, pending obtaining more information

— Approved a $1,940 bid to put an escape door in the upstairs of the west side fire station that is occupied by EMS

— Appointed Emergency Management Director Butch Scalf to also serve as the floodplain administrator
