A man convicted by a jury earlier this year on making indecent proposals to a child has been sentenced to 20 years in prison.

Tristan Avery Cartwright, 36, Cartwright, had been found guilty of the crime in February, although he was found not guilty on one count of child sexual abuse.

Jurors recommended 20 years in prison after finding him guilty of making a lewd or indecent proposal to a child under 16. This week, Bryan County District Judge Mark Campbell carried out the jury’s recommendation for punishment and sentenced Cartwright to 20 years in prison. He was given credit for time served.

Previously, a motion for a new trial was denied, according to court records, although Cartwright now plans to appeal his conviction with the Oklahoma Court of Criminal Appeals.

Charges were filed against Cartwright in May 2011 following an investigation by the Bryan County Sheriff’s Office that he sexually abused a 14-year-old girl, and also made a false entry into her daily planner stating that she planned to make up a story about molestation.

The affidavit states that the girl confirmed the planner was hers, but she said she had not made that entry. John Hoffpauir, then an investigator with the Bryan County Sheriff’s Office, procured handwriting samples from the girl, plus a written statement from Cartwright.

These were submitted to the Oklahoma County District Attorney Questioned Document Laboratory for examination. Hoffpauir, according to the affidavit, later received a report from the laboratory that stated it was probable the girl did not write the entry and there were indications that Cartwright did add the entry into the planner.
