Man sentenced to five years for leaving the scene of accident

A man accused of leaving the scene of an accident that killed a boy who was riding a skateboard has been sentenced to five years in prison.

Derrick Shawn Weaver, 23, pleaded no contest this week to failure to stop at the scene of a fatality accident that killed Jovani Lopez Santibanez in October 2010. He was sentenced to 10 years in prison as part of a plea agreement, however five years of the sentence were suspended.

According to Durant Police, Santibanez was riding his skateboard in the 600 block of South Fourth Avenue when he went down a driveway, into the roadway and in front of an oncoming pickup driven by Weaver.

Weaver’s pickup hit the boy, and according to the affidavit, Weaver left the scene. Witnesses found Weaver’s pickup in the 700 block of South Third Avenue where he was subsequently arrested.

Upon questioning, Weaver said he was on his way to work when he drove toward the middle of the street due to a vehicle that was parked on the side of the road. He said he then saw the child riding a skateboard down a hill toward him, the affidavit states. Weaver said he then swerved into the other line to try to avoid the child, but felt his truck hit him.

According to the affidavit, Weaver then saw the boy “laying in the street,” and he left the scene because he panicked. Police said that Weaver was not intoxicated at the time of the accident.

In other crimes, Bryan County Sheriff’s Deputy John Ray Haislip investigated a burglary recently at Nails Crossing and Fort McCulloch roads. George Hatfield said that several items, including a .22 rifle, .410 shotgun, welding helmet, weed spray and bumper jack were stolen out of his barn and a shed.

I know th family of Derrick. They are ALL good people. Derrick is a very nice young man. This accident is sad. The poor little boy who died is terrible to hear about. I am glad Derrick only got 5 years because this was a tragic accident for both parties. The negligent parents who let that boy roll out into the street. And it could have been any one of us who was driving there at that same time that killed the boy!!

The lesson here is if you let your kids play in the street.One day they will get hit. Same with fire or guns knives etc.....
