DURANT — Two men charged with scamming an elderly woman out of more than $4,000 have prior criminal records related to fraud.

Charles Nathan Herrin, 34, and Gary Santell Baker, 33, were charged Thursday with home repair fraud.

According to Durant Police, Herrin and Baker approached an 85-year-old woman on Jan. 15 and told her that a vent on her roof was a fire hazard and should be repaired as soon as possible.

The suspects convinced the woman to write them a check in the amount of $4,460, according to police, and promised she would be reimbursed by her insurance company.

Police said one of the suspects climbed up on the roof, but no work was done on the home and the check was cashed at a local bank.

Atoka County sheriff’s deputies arrested Baker later that month and Durant police detectives captured Herrin, according to Durant police.

According to a probable-cause affidavit, Herrin said he had been sentenced to 20 years in prison in 2001 for defrauding a 78-year-old man in a home repair scam.

Court records reveal Herrin was sentenced in Oklahoma County to 20 years, with 14 of those years suspended.

He also was convicted in 2000 in Grayson County, Texas, of theft of property. Herrin was given five years probation on that conviction.

Baker has a conviction for attempted confidence game in Pontotoc County in 2000. He was given a five-year suspended sentence.

WELL, LETS SEE IF GIVING A PERSON A SUSPENED SENTENCE MEANS ANYTHING..I WOULD LIKE TO SEE IF THEY HAD BEEN GIVEN ANY OTHER BREAKS IN THE PAST!!!
