A preliminary hearing for a man charged with murder for the death of his infant son has been postponed until October.

Marin Clay Allison, 23, was to have had a preliminary hearing Wednesday on a charge of first-degree murder by child abuse, however, at the request of Bryan County District Attorney Emily Redman, the hearing was moved to Oct. 15 because an autopsy report on the child’s death has not been received from the Oklahoma Medical Examiner’s Office.

Allison was charged in June following the completion of an investigation into the death of his 14-month-old son, Ethan Allison, in May at a Durant residence.

According to an affidavit, by Durant Police Lt. Chris Marcy, Allison, who said he was ill at the time, admitted to becoming frustrated with the boy on the evening of May 20. He said he grabbed him by his clothes and pulled him off his feet. The boy’s head then hit a tile floor with a lot of force.

The affidavit states that Allison stayed up all night researching head injuries and coma symptoms on the Internet. He called 911 at about 5:45 a.m. May 21 after the boy stopped breathing. According to police, Allison first said his son was injured from a fall, but during another interview June 11, he admitted the injuries were not from an accidental fall.

Ethan died May 22 at Children’s Medical Hospital in Dallas, Texas, after he was taken off of life support.

A doctor at Children’s Hospital completed an affidavit that states Ethan died of a severe and acute traumatic brain injury. According to Redman, there is specific language in the first-degree murder statute that states the death of a child as the result of child abuse is considered first-degree murder.

Allison is free on bond under the condition that he is under “house arrest” at his father’s home, and he is not allowed to leave the home without a parent.

In other crimes news:

* Sherran Glinn, 46, Durant, was indicted Wednesday by a grand jury on a federal charge of theft by officer or employee of gaming establishment on Indian lands, by U.S. Attorney’s Office in Muskogee.

According to the indictment, from May 21, 2011, and continuing to on or about August 29, 2011, Glinn, an employee of the Choctaw Casino and Resort, an Indian gaming establishment operated by the Choctaw Nation, did embezzle and willfully misapply and take and carry away with intent to steal, money in excess of $1,000.00, belonging to the Choctaw Casino and Resort. The charge arose from an investigation by the Choctaw Nation Police and the Federal Bureau of Investigation. The charge is in violation of Title 18, United States Code, Section 1168(b), which is punishable by up to 20 years in prison and/or up to a $1,000,000.00 fine.

* Chase Jackson Morris, 20, was arrested early today for public intoxication while walking down Highway 91 in Cartwright. A later search resulted in serious drug charges.

According to a Bryan County Sheriff’s Office report, Deputy Joe Kahlden observed Morris walking along the highway at 12:50 a.m. He made contact with the subject and observed a “slight odor of marijuana,” bloodshot eyes and slightly slurred speech.

A digital scale was found in his pocket during a search. Morris was transported to Bryan County Jail, and upon arrival, a glass pipe fell out of the patrol car, according to the report. A subsequent search turned up several clear plastic baggies, and a field test on the pipe showed positive for the street drug ecstasy.

Morris was booked into jail for suspicion of possession of controlled dangerous substance with intent to distribute, possession of drug paraphernalia and public intoxication.
