An Atoka woman arrested earlier this week for suspicion of attempting to sell marijuana in the Walmart parking lot has been charged.

Crystal Delain Kilpatrick, 30, was charged with possession of marijuana with intent to distribute.

She was arrested Monday evening after someone called a Durant police officer said a woman approached him and offered to sell him marijuana.

An affidavit states the suspect’s car was parked near the Murphy USA gas station. When an officer arrived, the car was observed leaving the station. The car was stopped in a parking lot a the southeast corner of Radio Road and University Boulevard.

The officer could smell an strong odor of marijuana, the affidavit states, and when Kilpatrick and a passenger were asked if there were illegal drugs in the car, both said they had borrowed the car, so they were not sure.

Inside a McDonald’s sack on the floorboard, the officer found a baggie that contained 17 grams of a green, leafy substance. Kilpatrick and the passenger, Tamara R. Smith, 32, Caney, were arrested. According to the affidavit, Smith said they had driven to Dallas and that Kilpatrick had obtained marijuana but she was not sure what she planned to do with it.

Kilpatrick, the affidavit states, said she was going to try to sell the marijuana to obtain money to buy her children school clothes. She said that after seeing several kids in the parking lot, she approached them and attempted to sell them marijuana.

When asked why she approached them, she replied, “because they looked like college kids that might smoke some weed,” the affidavit states. Smith was charged with misdemeanor possession of marijuana.
