Man charged with 14 crimes, including rape and burglary

A Durant man was charged Wednesday with 14 crimes in connection with rape, child pornography and automobile burglaries.

Sean Joseph Gene Wyatt, 20, was charged with one count of first-degree rape involving a victim under 14, one count of second-degree rape with a victim under 15, possession of child pornography, soliciting sexual conduct or communication with a minor by use of technology, six counts of second-degree burglary, two counts of unauthorized use of a debit card, one count of knowingly concealing stolen property and one count of malicious injury to property.

The charges are the result of the completion of an investigation by the Durant Police Department, who were investigating Wyatt as a suspect in automobile burglaries and incidents of vandalism.

According to a probable-cause affidavit, Durant Police searched Wyatt’s apartment last month in the 3800 block of West University Boulevard and seized his cell phone. He was told it would be analyzed for evidence related to the burglary investigations.

During a forensic analysis of the phone, Detective Michael Shufeldt found photos of a young girl dressed only in a bra and panties and also one of Wyatt hugging and kissing the girl, the affidavit states.

Shufeldt then obtained a search warrant to search the phone for evidence of crimes against children. According to the affidavit, one image shows the girl slightly pulling her panties down and another shows her with her breasts exposed. Shufeldt also found numerous text messages between Wyatt and the girl, including one when Wyatt asked if she could “sneak out,”and he also texted he wanted a (sexual act) for his birthday.”

Oklahoma State Bureau of Investigation Agent Reanae Childers interviewed the girl and according to the affidavit, she said they had done a sexual act three times and each occasion, they were at Wyatt’s parents’ home. She also disclosed that the relationship escalated into sexual intercourse.

According to court papers, the incidents happened in 2011 and 2012. The first-and-second-degree rape charges are due to the girl’s age. Sexual intercourse with a minor under 14 is considered first-degree rape and when the person is under 15, it is second-degree rape, according to state statutes.

The affidavit states that the girl said she first had intercourse with Wyatt sometime in approximately the summer of 2011 and that she would have been 12 or 13. She stated that she sex with him three times, the first at his parents’ home, then in Wyatt’s vehicle and finally, at his apartment. She said that the last time was in the summer of 2012.

Wyatt was charged with possession of child pornography due to the photos of the girl found on his cell phone and also, because the phone was used to solicit sexual conduct due to the text messages that occurred at about 1:45 a.m. Aug. 11, when Wyatt asked her if should could “sneak out tonight at all,” the affidavit states.

Wyatt is also charged with burglarizing six vehicles, one at High Meadows Apartments, three on Kimber Lane and two on Roadrunner Road. According to court papers, he knowingly concealed property taken from four people and also used two debit cards that were stolen.

There were numerous vehicle windows that had been shot out with a BB gun during the same time frame as the automobile burglaries, and during the search of Wyatt’s apartment, officers found stolen items, plus several BB guns, according to the affidavit.

Wyatt confessed to the burglaries, vandalism incidents and the use of the debit cards, according to police.

According to the sheriff’s office, Wyatt turned himself in Wednesday and he has since been released on bond.
