An Achille man has been arrested for suspicion of murder following an investigation by the Achille Police Department and the Oklahoma State Bureau of Investigation.
Forty-four-year-old Justin Michael Stone was charged Monday with first-degree murder for the shooting death of 68-year-old James Roy Scoggins.
Achille Police were dispatched on July 18 to a home at 311 S. Seventh St. in Achille and when offi cers arrived, they discovered Scoggins deceased in bed with a gunshot wound to the back of his head, according to an OSBI probable-cause affidavit.
OSBI agent Zachary Brown interviewed the victim’s brother, Timothy Lee Scoggins, and he was told that James Scoggins and Stone had been in a dating relationship for about eight years, the affidavit states. Timothy said he tried to call his brother, and the call was not answered, so he drove to the residence to check on him and no one answered when he knocked on the door.
The affidavit states that when Timothy tried to open the door, Stone blocked it, but Timothy was able to push his way inside. He described seeing Stone as “white, pale and his eyes were huge.”
Timothy found his brother deceased in bed, according to the affidavit, and Stone said, “Call a genealogist. I will get James a new body. Just call them and I will get him a new body.”
When officers arrived on the scene, Stone fled and said he was going to Dallas where James had adopted him, according to the affidavit. According to OSBI, Colbert Police located Stone and arrested him.
The affidavit states that an H&K .45 caliber pistol was found under the pillow that James was lying on and there was a spent .45 cartridge case on the bed.
Stone’s bond was set at $1,000,000 based upon a recommendation from the District Attorney’s Office. A preliminary hearing conference for Stone is scheduled Aug. 13.
