A man arrested at the scene of a shooting that injured one person last week in Bokchito has been charged with two felonies. Sixty-six-year-old Wyman Arlin McMillin of Bokchito has been charged with assault and battery with a deadly weapon and possession of a firearm after former felony conviction. Bokchito Police and the Bryan County Sheriff’s Office responded on July 27 to 9151 State Highway 22 after Andrew Garcia dialed 911 and said he had been shot in the head with a shotgun by McMillin, who is his uncle, an affidavit states.
Garcia was transported to Medical City Plano in Plano, Texas, and he was interviewed by Oklahoma State Bureau of Investigation Agent Jason Lawless. According to the affidavit, Garcia said he had been living on McMillin’s property since January and he had been in many arguments with his uncle, who had threatened to shoot him in the past and he found a bullet hole in the window of his camper.
The affidavit states that on the afternoon of July 27, Garcia went to McMillen’s to get a drink of water, and the door was locked, so he knocked and when the door was opened, Garcia said he saw Mc-Millin with friends, and they were drinking and using drugs.
Garcia’s dog then ran inside the home, and that caused an argument with Mc-Millen, according to the affidavit, and McMillin threatened to shoot Garcia.
Garcia said he told Mc-Millin that if he was going to shoot him, to come outside and do it, the affidavit states. Garcia went to his camper to retrieve his shotgun, and McMillen came out and fired a shot, striking Garcia in the head. Garcia said he did not raise or point his own shotgun at McMillen, according to the affidavit.
Ronald Robert Oliver, a witness, told OSBI Agent Zachary Brown that he thought McMillin was trying to shoot over Garcia’s head, the affidavit states. JD “Doc” Driggers, another witness, said he saw McMillin grab a shotgun and that he fired two shots before coming back into the home.
OSBI Lt. John Graham found a Mossberg 20-gauge shotgun with pistol grip behind a washer and dryer, according to the affidavit, and a Smith & Wesson .380 pistol also was found.
The affidavit states that McMillin has been convicted of multiple prior felonies. McMillin’s bond was set at $150,000, and he has a preliminary hearing conference scheduled for Aug. 26, according to court records.
